Despite lawsuit, Minnesota’s nudification law is in effect

Minnesota is now the first state in the U.S. to have an active ban on types of AI technology that allow users to create and post fake images of people naked without their consent.

The new law would impose a $500,000 fine on an AI company each time a person uses the “nudification” technology. It also allows people whose images were used to seek damages.

This comes despite a lawsuit to halt the bill by Elon Musk’s artificial intelligence company, x.AI LLC. The AI company alleged the new law would infringe on the company’s First Amendment Rights, as well as those of its users in Minnesota.

“I would argue that there is no First Amendment right to falsely exploit somebody’s image and make them appear naked,” said Attorney General Keith Ellison.

While the effort to halt the bill was denied, the case is still headed to court. Briefings are scheduled in August, with a hearing set for Aug. 19.
